Terms of Service

These Terms of Service ("Terms") govern your access to and use of the BalkanBook platform, including our website, APIs, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Service Description

BalkanBook is a software-as-a-service (SaaS) booking platform designed for tourism agencies, tour operators, and activity providers in the Balkans. The Service enables you to create online booking pages, manage activity schedules and availability, accept payments through local payment processors, and track your business performance through an agency dashboard.

BalkanBook provides the technology infrastructure for online bookings. We are not a travel agency, tour operator, or payment processor. We do not own, operate, or manage the activities listed on our platform. The contractual relationship for any booking is between the agency and the customer.

2. Account Terms

To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access or security breach.

You must be at least 18 years of age to create an account and use the Service. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are creating an account on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

You are responsible for ensuring that your use of the Service complies with all applicable laws and regulations in your jurisdiction, including tourism regulations, consumer protection laws, and tax obligations.

3. Payment Terms

BalkanBook offers multiple subscription plans with different pricing tiers. Paid plans are billed on a monthly or annual cycle, as selected at the time of purchase. All prices are in Euros (EUR) unless otherwise stated. Subscription fees are non-refundable except as required by applicable law.

In addition to subscription fees, BalkanBook charges a commission on each booking processed through the platform. The commission rate depends on your subscription plan: 8% for Free, 4% for Pro, and 2% for Enterprise. Commission is calculated on the booking value excluding taxes and is deducted automatically before settlement to your account.

If your payment method fails or your account is past due, we may suspend access to the Service until payment is resolved. We reserve the right to change our pricing with 30 days' written notice. Price changes will take effect at the start of your next billing cycle.

4. Acceptable Use

You agree to use the Service only for its intended purpose: managing and selling tourism activities and experiences. You must not use the Service for any illegal, fraudulent, or unauthorized purpose, including but not limited to selling illegal goods or services, conducting financial fraud, or violating any applicable laws.

You must not send unsolicited commercial messages (spam) through the Service, attempt to reverse engineer, decompile, or disassemble any part of the Service, interfere with or disrupt the integrity or performance of the Service, or attempt to gain unauthorized access to the Service or its related systems.

We reserve the right to investigate and take appropriate legal action against anyone who violates this provision, including terminating their account and reporting them to law enforcement authorities.

5. Data Ownership

Your data is yours. You retain all ownership rights to the content, data, and materials you upload to or create through the Service, including activity descriptions, images, pricing information, and customer booking data. We do not claim ownership of your content.

By uploading content to the Service, you grant BalkanBook a limited, non-exclusive, worldwide license to use, display, and distribute that content solely for the purpose of providing and improving the Service. This includes displaying your activities on booking pages, generating reports, and sending booking confirmations on your behalf. This license terminates when you delete your content or close your account.

You can export your data at any time in standard formats (CSV, JSON) through the agency dashboard. Upon account termination, you will have a window to export your data before it is deleted (see Section 7).

6. Liability Limitations

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

To the maximum extent permitted by applicable law, BalkanBook and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you have paid to BalkanBook in the twelve (12) months preceding the claim. Nothing in these Terms shall limit or exclude liability for death, personal injury, or fraud.

7. Termination

Either party may terminate these Terms at any time. You may close your account at any time through your account settings or by contacting our support team. Upon termination by you, your access to the Service will end at the conclusion of your current billing period.

We may suspend or terminate your account immediately if you violate these Terms, fail to pay applicable fees, or if we are required to do so by law. We will provide reasonable notice before termination when possible.

Upon termination, you will have 30 days to export your data through the dashboard. After this 30-day window, your data will be permanently deleted from our active systems. Backup copies may persist for up to 90 days before being purged.

8. Changes to Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. When we make material changes, we will provide at least 30 days' notice before the changes take effect, either by email or through a prominent notice on the platform.

Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and close your account before the changes take effect.
